Bremen fordert 50 000
Euro Strafe von AC Mailand
Der italienische Fußballclub AC Mailand soll 50 000 Euro Strafe
an die Hansestadt Bremen zahlen. Die AC-Spieler hatten beim 1:1 im Uefa-Pokalspiel bei Werder Bremen am
auf ihren Trikots für den privaten Wettanbieter „bwin“ geworben. Das ist in Bremen aber seit 2006
verboten. Der Bescheid über das Zwangsgeld werde in den nächsten Tagen an den Mailänder Verein geschickt,
sagte der Sprecher der Behörde für Inneres und Sport, Rainer Gausepohl. Der Fußballclub sei vor dem Spiel
über das Verbot informiert worden. „Sie haben aber über ihren Anwalt mitteilen lassen, dass sie das
rechtlich anders sehen.“ Werder Bremen hatte bis zu dem Werbebann ebenfalls auf den Trikotsund im
Weserstadion für den Sportwettenbetreiber geworben. Das Stadtamt untersagte dies, weil Wettspiele und die
Werbung dafür in Bremen verboten sind. Der Bundesliga-Verein klagte dagegen vor dem
Oberverwaltungsgericht, musste aber eine Niederlage hinnehmen.
President Obama has swiftly done what he said he was going to do upon taking office. He signed a stimulus
package Bill into law and now turns his attention to other pressing issues.
One of those
issues is online gambling laws in the US, and how they are affecting the country's relationship with
other nations. The European Union is prepared to recommend action against the US to the World Trade
Organization, but before they do, they will give Obama the chance to make things right.
"The
report next month will back the EU's position, but the Commission intends to deliver its findings to
Washington which it hopes will persuade the US to start bilateral talks to find a solution without going
to the WTO," a source told Rueters.
The report will be the conclusion of an ongoing
investigation by the EU to figure out whether the US has violated trade agreements with their 2006
Unlawful Internet Gambling Enforcement Act law. The EU is concerned that the US devastated European
Internet gambling companies that are legally registered outside the US, with the UIGEA.
Millions of dollars were lost for publicly traded Internet gambling companies after the law took
affect. It will now be up to President Obama to try and be the peacemaker he has made himself out to
be.
Prior to Obama taking office, the last administration worked on a different set of rules.
They did not give much regard to what other countries thought of their policies. Obama has pledged that
his administration would be more pen to negotiation rather than dictator status in the World.
"This Obama's chance to show the world and the EU in particular that it is a new day in the US. They
are able to abide by trade agreements and they do hold in high regard agreements that have been made
involving free trade," said observer Barry Glassberg.
The UIGEA prohibits financial
institutions from processing transactions to and from Internet gambling companies. The rules of the UIGEA
were just published late last year, and it was one of the Bus Administration's midnight laws that could
be reviewed by the new administration.
Members of Obama's team, including Rep. Barney Frank,
are looking to overturn the UIGEA and regulate the online gambling industry in the US. Obama himself has
made his intentions clear to keep Internet commerce free from government intervention.

Stadt Bremen will Zwangsgeld vom AC Mailand Bremen (dpa) - Die Stadt Bremen will den Fußballclub AC
Mailand zur Zahlung von 50 000 Euro Strafe auffordern. Die AC-Spieler hatten beim UEFA-Pokalspiel gegen
Werder Bremen auf ihren Trikots für den privaten Wettanbieter «bwin» geworben, was in der Hansestadt
verboten ist.
Das Stadtamt werde einen entsprechenden Brief am 26. Februar verschicken, sagte
der Sprecher der Behörde für Inneres und Sport, Rainer Gausepohl. Der Verein kündigte bereits über seinen
Anwalt an, dass er die Strafe nicht zahlen werde.
«Wir stützen uns dabei auf europäisches
Recht», sagte der Stuttgarter Anwalt Clemens Weidemann von der Sozietät Gleiss Lutz und bestätigte damit
einen Bericht des «Weser Kuriers». Die Europäische Kommission habe bereits mehrmals darauf hingewiesen,
dass das Werbeverbot den Gesetzen der Europäischen Gemeinschaft widerspreche. «Es ist absurd, dass der AC
Mailand in Bremen mit nackter Brust spielen soll.» Deshalb werde sein Mandant vor dem Verwaltungsgericht
Bremen gegen das Zwangsgeld klagen.
Nach Angaben von Gausepohl wird es auch so für die
Hansestadt schwierig, die Strafe einzutreiben. Da es keine Vollstreckungsvereinbarung zwischen
Deutschland und Italien gebe, könnten die Beamten nicht einfach in Mailand anrücken. «Man könnte
natürlich das nächste Mal, wenn der Verein hier spielt, das Geld eintreiben», merkte Gausepohl an.
Die Erfolgsaussichten seien aber gering, betonte Weidemann. Auch Bayern verlange vom AC
Mailand nach einem Spiel im Frühjahr 2007 in München 100 000 Euro Strafe wegen der «bwin»-Trikots. Das
Geld habe der Verein aber bis heute nicht gezahlt. Ähnlich ist es beim spanischen Fußballclub Real
Madrid, der im Herbst 2007 bei einem Spiel in Bremen für den Sportwettenanbieter warb. Das verhängte
Zwangsgeld habe die Stadt immer noch nicht erhalten.
Online bookie Bwin is funding a website that links to unauthorised live internet broadcasts of Premier
League and other football matches, according to a BBC Radio 4 investigation.
myp2p.eu, which
is based in The Netherlands, acts as a hub for online streams uploaded to the net by football fans around
the world. While these fans are likely to be breaking copyright law for taking satellite feeds onto their
computer and broadcasting them on the net, it's far less clear that the aggregator is doing anything
wrong, Akash Sachdeva, a copyright expert at law firm Allen and Overy told Radio 4's You and Yours on
Friday.
The site, which has been running three years, last month won a court case brought by
the Scandinavian branch of Canal+, lifting an injunction prohibiting it from offering links to streamed
coverage of the major European football leagues (English Premiership, La Liga, Serie A etc). myp2p.eu was
awarded costs according to online reports (Italian story - translation here) and myp2p.eu itself
(coverage of case here).
BBC researchers looked at the site during a match night, finding that
odds for matches in play were displayed in ads running on the site. Surfers were invited to respond to
these ads by placing a bet with Bwin.
In return, Bwin is paying a referral fee back to the
website. Bwin is the official shirt sponsor of European football giants Real Madrid and AC Milan, so its
involvement in a site of uncertain legality that is arguably taking money out of the game is
questionable.
Bwin spokesman Kevin O'Neal told Radio 4 it has had an affiliate relationship
with myp2p.eu since February 2007. He compared the site to a phone book or TV listing, and sidestepped
accusations it was funding a website that only existed because of piracy.
"There is no
relationship between Bwin and any streamer of content," he said. "Viewers are not breaking any laws and I
know for a fact Bwin is not breaking any laws."
He explained that Bwin, having reviewed
myp2p.eu and discussed the issue with its lawyers, intended to maintain a commercial relationship with
the site as long as it wasn't doing anything ruled to be illegal.
Bwin declined to say how
much money it was paying the site, but did say that it typically shares 25-30 per cent of gross gaming
revenues with affiliates.

Poker Revenue Falls As "Poker market remains highly competitive across Europe"

Plc, the publicly quoted owner of ParadisePoker, today announced its interim results for the second
trading quarter ending Jan. 31 2009.
Poker revenue in the period was £5.3 million, down 13
percent from £6.1 million in the same period of 2007/08 while for the ParadisePokersix months to Jan. 31
2009 revenue was £9.7 million, down 10 percent on the same quarter a year earlier.
In its
statement the company said, “Poker now accounts for just 12 percent of the Group’s revenue, down from 15
percent in quarter two 2007/8. Poker remains challenging as the environment remains very competitive with
large US-focused poker companies, in particular, using their significant cash flow and high liquidity to
attract European customers.”
Last year ParadisePoker experienced a drop of 18 percent in poker
revenue.
The company, which also operates online sportsbook, casino and gaming, saw overall
net gaming revenue up 6 percent in the second quarter to £43.6 million from £41.2 million a year earlier
while operating profit was up 35 percent to £10.1 million.
EU online poker and Internet gambling operators learned late February that the European Commission ended
its formal investigation into the U.S. clampdown on EU gaming companies. When the Commission's report is
released this month, it reportedly will conclude that the United States did violate global trade
agreements by targeting EU online gaming companies for legal enforcement while allowing corresponding
U.S. companies to operate freely in the US market upon passage of the 2006 Unlawful Internet Gambling
Enforcement Act (UIGEA).
Sources familiar with the probe's findings said the Commission is
expected to recommend taking action against the U.S. to the World Trade Organization (WTO). But they
first expect the EU executive, who oversees trade policy for the 27-nation bloc, to try to dialogue with
the new Obama administration to negotiate a solution before they go to the global trade watchdog body,
the WTO, with a legal case.
"The report next month will back the EU's position," a source told
Reuters in Brussels late February, "but the Commission intends to deliver its findings to Washington
which it hopes will persuade the US to start bilateral talks to find a solution without going to the
WTO."
"A case would take a very long time tied up at the WTO and in the current spirit of
avoiding protectionist moves in line with the G20 (Group of 20 emerging and industrial nations)
statement, action should be avoided," the source added.
EU online gambling operators ideally
hope that the Obama administration will either repeal the UIGEA, or reach an agreement with countries
that have legal, regulated and licensed online gaming companies. However, the EU could choose to make up
their losses by taking compensation in other business sectors.
The UIGEA makes it illegal for
financial institutions to process transactions between US residents and Internet gambling companies,
though it's been left to the institutions to determine who those companies are. The UIGEA rules were
first published late last year, and their enactment was one of the Bush Administration's 'midnight drop'
laws that could be reviewed by the new administration.
Meantime, Barney Frank (D-Mass),
Chairman of the House Committee on Financial Services, has announced that he will launch a new round of
efforts to establish a licensing and regulatory (and tax) framework for online gambling operators.

Die UEFA spricht sogar von einer bestehenden existentiellen Gefahr für
den Fußball. Die Europäische Fußballunion ermittelt derzeit im Umfeld von 25 Spielen aus den Jahren 2006,
2007 und 2008, bei denen auffällige Wettbewegungen notiert wurden. Es handelt sich um Partien der UEFA
Intertoto-Runde, der Champions League Qualifikation und der UEFA Cup Qualifikation.
Von den
Anfängen in die Jetztzeit
Das Internet hat unsere Kultur um zahllose Kommunikationsformen

Keine Chancengleichheit in Europa
Der Deutsche
Fußball-Bund und die Deutsche Fußball-Liga raten entgegen der jüngsten politischen Entwicklung, die in
der Ratifizierung des Staatsvertrages und der Bestätigung des Staatsmonopols zum 1. Januar 2008
kulminierte, zu einer Liberalisierung der Sportwette auf Basis eines Modells, dass die sich wandelnden
Marktbedingungen berücksichtigt und durch Konzessionen eine kontrollierte Marktöffnung herbeiführt.
Dieses Modell hatte der Wettbeauftragte des DFB dem Sportausschuss des Deutschen Bundestages im September
2006 vorgestellt.
Viele Argumente sprechen für diese Position, etwa das Ringen der
Profivereine in Deutschland um eine Chancengleichheit mit der finanziell starken europäischen Konkurrenz.

Monopol als Reglungsinstrument für Glücksspiele nicht praktikabel sein kann und damit keine Zukunft haben
